India's Laws Prevent Healthcare Outsourcing

The $800 million dollar medical transcription industry should be an easily accessible market for Indian BPO firms to enter.  The absence of a law on medical transcription, however, is preventing many companies from outsourcing work to India.  By not providing a strong legal framework regarding the privacy of medical records, companies outsourcing transcription to India may not comply with the Health Insurance Portability and Accountability Act (HIPPA), a failure accompanied with stiff penalties. The Telegraph Reports:

The norms allow patients to see and obtain copies of their medical records.  The authorities have to provide access within 30 days.  Notice of privacy practices, covered health plans, doctors and other healthcare providers must provide notice to their patients on how they use the personal medical information and their rights under the new privacy regulations. "This is not available in India," said Duggal.
